Unsafe or Recalled Products

Items that have been recalled by regulators or manufacturers are prohibited on TuttiReal. Upon notice, TuttiReal removes recalled items as stated in TuttiReal’s Prohibited Items Policy. It is TuttiReal’s policy to cooperate with regulators in removing recalled products.

In addition, sellers are required to comply with TuttiReal policies and all applicable laws and regulations in applicable jurisdictions, such as the seller’s location and the locations to which they ship their items. For example, if a buyer alerts a seller that an item they purchased is unsafe, the seller may be obligated to report it to applicable regulators and work with regulatory officials to recall the items and contact affected buyers. 

The information below is a non-exhaustive overview regarding reporting unsafe products and recalls for certain markets, for educational purposes only, subject to change over time, and does not constitute legal advice. Please consult a licensed lawyer in your area for legal assistance.

United States: Consumer Product Safety Commission (CPSC)

The United States Consumer Product Safety Commission (CPSC) is charged with protecting the public from unreasonable risks of injury or death associated with the use of the thousands of types of consumer products under the agency’s jurisdiction. CPSC’s work to ensure the safety of consumer products such as toys, cribs, power tools, cigarette lighters, and household chemicals contributed to a decline in the rate of deaths and injuries associated with consumer products over the past 40 years.

If you are a manufacturer, importer, distributor, and/or retailer of consumer products in the US market, you have a legal obligation to immediately report unsafe and/or non-compliant products to the CPSC.

European Union: Safety Gate

Safety Gate is the EU system for dangerous consumer products, with the exception of food, pharmaceuticals and medical devices. Safety Gate (previously known as RAPEX) enables quick exchange of information between European countries and the European Commission about dangerous non-food products posing a risk to health and safety of consumers. The alerts include detailed information on the products concerned, the risks, the notifying Member State, and the measures adopted in response. 

Businesses must:

  • only place products which are safe on the market
  • inform consumers of any risks associated with the products they supply 
  • make sure any dangerous products present on the market can be traced so they can be removed to avoid any risks to consumers.

United Kingdom: Office for Product Safety and Standards (OPSS)

The Office for Product Safety and Standards (OPSS) is the UK Government’s enforcement authority for a range of goods-based and standards-based regulations. OPSS was created in January 2018 to deliver consumer protection and to support business confidence, productivity and growth. They regulate a wide range of products with a focus on their safety and integrity. They work with local, national and international regulators, with consumer representatives and with businesses to deliver effective protections and to support compliance. Their mission is to be a trusted product regulator for the UK. 

Businesses supplying goods on the UK market must notify the relevant authority when they become aware that a product they have placed on the market, supplied, or distributed is unsafe and poses a risk to the user, or is noncompliant with the relevant legislation.

Australia: Australian Competition and Consumer Commission (ACCC)

Product safety regulation in Australia is a shared responsibility between the Australian Competition and Consumer Commission and the states and territories. The Product Safety Australia website is managed by the ACCC on behalf of Commonwealth, state and territory product safety regulators. The ACCC’s role is to identify and address the risk of serious injury and death from safety hazards in consumer products. 

The ACCC has simplified information about how to conduct a consumer product recall, along with essential information and tools to support you when running a recall – including a checklist, sample messages, templates and recall plan. The ACCC also provides information about mandatory standards for safety or information features on products.

All businesses located in Australia or selling to Australia, including small and online businesses, must make a report to the Australian Competition and Consumer Commission if a product they have sold causes a death, serious injury or illness. Reports can be made online, and must be made within 2 days of becoming aware of a serious incident. Making a report helps the ACCC to stop other people from getting hurt.

Canada: Health Canada

Health Canada is responsible for helping Canadians maintain and improve their health. It ensures that high-quality health services are accessible, and works to reduce health risks. They are a federal institution that is part of the Health portfolio

If you sell, import or manufacture consumer products in Canada for commercial purposes, you must report health or safety incidents involving a consumer product to both Health Canada and to the person who supplied you with the product.

France: RappelConso by République Française

RappelConso is the French public consumer information site on recalls of “general public” consumer products, including food and non-food, but excluding medicines and medical devices. 

Global: Organization for Economic Cooperation and Development (OECD)

The GlobalRecalls portal brings together information on product recalls being issued around the world, on a regular basis, together in one place. The portal includes information on mandatory and voluntary consumer product recalls which were issued by a governmental body and were made publicly available.
